Board of Management Appeal Letter Ireland — Stage 1 Guide
If your child has just been refused a place at a school, the fastest and cheapest route to challenge that decision is a Board of Management review. This is the first stage of a school appeal in Ireland, provided for under section 29A of the Education Act 1998 (as amended by the Education (Admission to Schools) Act 2018).
This guide covers who can request a review, the deadline, what grounds actually persuade a Board, and exactly what to put in your letter.
You have 21 calendar days. A request for a Board of Management review must reach the school within 21 calendar days of the date of the refusal decision — not 21 school days, and not from when you read the letter. Count from the date on the school's refusal notice.
What Is a Board of Management Review?
Every recognised school in Ireland is run by a Board of Management, which is legally responsible for the school's admission policy and admission decisions. If the school refuses your child a place, section 29A gives you the right to ask that same Board to review its own decision before you go any further.
It is free, does not require legal representation, and — because it stays within the school — is often the quickest way to fix a straightforward error, such as a misapplied sibling rule or an overlooked catchment criterion.
Do I Have to Do This Before Appealing to the Department?
No. A Board of Management review is optional. You are entitled to go straight to a Section 29 appeal to the Department of Education instead, or in parallel. But because a review costs nothing and can resolve matters within the school itself, it is usually worth doing first — provided you can still meet the 63-day Section 29 deadline if the review is unsuccessful.
What Grounds Work at Board of Management Stage?
A Board of Management review succeeds when you can show the school did not correctly apply its own published admission policy. Strong grounds include:
- Sibling rule misapplied — your child has a sibling currently enrolled and the policy gives sibling preference, but this was not properly weighted
- Catchment or feeder school criterion — your address or previous school qualifies under the policy's stated priority order
- Application process error — your application was received on time but treated as late, or supporting documents were overlooked
- Oversubscription criteria applied out of order — the school's own published order of priority was not followed when places were allocated
- Factual error — the refusal is based on incorrect information about your child, your address, or your application
Because the Board is reviewing its own decision, framing your letter around specific clauses of the school's published admission policy — quoting them where possible — is far more effective than a general complaint.
There is no fee for a Board of Management review. It is a free right under section 29A of the Education Act 1998.
What Your Letter Should Include
- Your name and address, and your child's full name and date of birth
- The school's name and address, addressed to the Chairperson of the Board of Management
- The date of the refusal decision and a statement that your request is made within the 21-day time limit under section 29A
- The academic year and class you applied for
- Your grounds, each referencing the specific part of the school's admission policy you say was misapplied
- A clear request that the Board review and reverse its decision
How to Submit Your Request
Send your letter to the Chairperson of the Board of Management at the school's address — by post, or by email if the school accepts admissions correspondence that way. Keep a dated copy and, if posting, use registered or tracked delivery so you can prove it arrived within the 21-day window.
What Happens After You Submit It?
The Board of Management must consider your request and respond. Outcomes are typically one of:
- The Board reverses its decision and offers your child a place
- The Board upholds its original decision, in which case you can proceed to a Section 29 appeal to the Department of Education
If the Board upholds the refusal, don't lose track of your Section 29 deadline — it runs from the date of the original refusal, not from the date of the Board's review outcome, so act promptly.
