Two stages of appeal
Which stage are you at?
Stage 1 — Act fast

Board of Management Review

21 days

Request a review from the school's own Board of Management. Must be lodged within 21 calendar days of the refusal decision. This is your first step — many are resolved here.

Stage 2 — Department of Education

Section 29 Appeal

63 days

If the BOM review fails, appeal to the Department of Education under Section 29 of the Education Act 1998. Check the Department's current procedures for the time limit.

Legal basis

Your right to appeal is guaranteed by law.

The Education (Admission to Schools) Act 2018 overhauled how Irish schools handle admissions. Every school must publish an annual admission notice, follow a published admission policy, and notify parents of the right to appeal.

Section 29 of the Education Act 1998 gives every parent the right to appeal a school's refusal decision to the Department of Education. A well-structured letter citing the relevant legal provisions is the foundation of a successful appeal.

Free support is also available from Citizens Information and Tusla (TESS).

Re: Request for Review of Decision to Refuse Admission — Aoife Murphy, DOB: 14 March 2021

I write as parent of Aoife Murphy (DOB: 14 March 2021) to formally request that the Board of Management undertake a review of the school's decision dated 10 June 2026 refusing admission to St. Patrick's National School for Junior Infants in the academic year 2026–2027.

This request is made pursuant to the Education (Admission to Schools) Act 2018 and the school's published Admission Policy, and is made under Section 29C of the Education Act 1998, which provides for a review by the Board of Management of a decision to refuse admission.

I respectfully submit the following grounds in support of this review request:

Ground 1 — Sibling currently attending the school: Aoife's elder sibling, Ciarán Murphy, is currently enrolled in Second Class at St. Patrick's National School. The school's Admission Policy expressly provides preferential placement to siblings of current pupils. The school's decision fails to correctly apply this criterion in the circumstances of this case...

Yours sincerely,

Sinéad Murphy

Common questions
FAQ
How do I appeal a school refusal in Ireland?+
There are two stages. First, request a Board of Management review within 21 calendar days of the refusal. This is a formal written request to the school's own board. If that fails, you can appeal to the Department of Education under Section 29 of the Education Act 1998. A Board of Management review under Section 29C is mandatory before a Section 29 appeal where the refusal was because the school was oversubscribed, and optional for other refusal reasons. Check the Department's current procedures for the appeal time limit.
What is the deadline for a school appeal?+
The Board of Management review must be requested within 21 calendar days of the date of the school's refusal letter. The Section 29 appeal to the Department of Education has its own time limit, which the Department sets in its procedures, so confirm it as soon as you have the review outcome. These deadlines are strict — missing them can forfeit your right to appeal.
What grounds can I use to appeal a school refusal?+
Common grounds include: the school did not correctly apply its admission policy; your child has a sibling currently attending; medical or special educational need; your child is in the school's catchment area; the school failed to follow the correct process under the Education (Admission to Schools) Act 2018; or there is no other reasonable school available.
Do I need a solicitor to appeal a school refusal?+
No. You can appeal without a solicitor. The most important thing is a well-structured written letter that clearly states your grounds and cites the relevant legal provisions. SchoolAppeal.ie generates that letter for you. Free advice is also available from Citizens Information and Tusla TESS.
What happens at a Board of Management review?+
The BOM must consider your written request and respond within 42 days. They will review whether the school correctly applied its admission policy in your child's case. If they uphold the refusal, you can proceed to a Section 29 appeal to the Department of Education.
What is a Section 29 appeal?+
A Section 29 appeal is an appeal to the Department of Education under Section 29 of the Education Act 1998. An independent appeals committee decides the case and can direct the school to admit your child. Appeals are lodged through the Department of Education at section29appeals.gov.ie.
Can I get a refund?+
Yes. We offer a 48-hour money-back guarantee: if the letter was not what you needed, contact us within 48 hours of purchase and we will refund you in full. See our Refund Policy.
